Wills play a significant role in every estate plan, therefore, every adult should have a will. It is difficult to accurately predict the size of your estate when you die. Avoiding probate is a goal of many estate plans. However, bequests from your family, circumstances surrounding your death, or unknown assets may make probate necessary. If it is necessary to probate your estate, a well-written and executed Last Will and Testament will save time and money. Some people believe they can write their own will, but these documents may cause problems. If the will is written poorly or not witnessed properly, the state may decide how your assets are distributed using the rules of intestate succession. This process can be expensive, time consuming and run counter to your distribution wishes.
